These conditions are valid exclusively between the company Mastromedia of Mastrorocco Antonio, with registered office in Piazza Papa Giovanni Paolo II - 70044 Polignano a Mare (BA), REA BA-574267, VAT 07649470726, Fiscal Code MSTNTN83E11F262N, hereinafter referred to as ''MASTROMEDIA'' and any person who makes online purchases on the website www.mastromediapix.it hereinafter referred to as ''CUSTOMER''. These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force
These conditions regulate purchases made on the site www.mastromediapix.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and by Legislative Decree 70/2003 on electronic commerce.
ARTICLE 1 - Subject of the contract
With these general conditions of sale, MASTROMEDIA sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the website www.mastromediapix.it. The contract is concluded exclusively through the internet, by the CUSTOMER's access to the address www.mastromediapix.it and the execution of a purchase order according to the procedure provided by the site itself.
The customer undertakes to take note, before proceeding to confirm their order, of these general conditions of sale, in particular the pre-contractual information provided by MASTROMEDIA and to accept them by ticking a box in the indicated box.
In the order confirmation email, the CUSTOMER will also receive the link to download and store a copy of these general conditions of sale, as provided for by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005
Before the conclusion of the purchase contract, the CUSTOMER takes note of the characteristics of the goods that are illustrated in the individual product sheets at the time of choice by the CUSTOMER.
Before the conclusion of the purchase contract and before the validation of the order with 'obligation to pay', the CUSTOMER is informed about:
- total price of the goods including taxes, with the detail of shipping costs and any other cost;
- payment methods;
- the deadline within which MASTROMEDIA undertakes to deliver the goods;
- conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these conditions) as well as the standard withdrawal form referred to in Annex I, part B of Legislative Decree 21/2014;
- information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
- existence of the legal guarantee of conformity for the goods purchased;
- conditions of after-sales assistance and commercial guarantees provided by MASTROMEDIA.
The CUSTOMER can at any time and in any case before the conclusion of the contract, become aware of the information relating to MASTROMEDIA, the geographical address, telephone and fax number, email address, information that is also reported below:

ARTICLE 3 - Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by MASTROMEDIA to the CUSTOMER of an order confirmation e-mail. The e-mail contains the CUSTOMER's data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to be able to print and store a copy of these conditions.
The CUSTOMER undertakes to check the correctness of the personal data contained therein and to promptly communicate any corrections to MASTROMEDIA.
MASTROMEDIA is committed to describing and presenting the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may be highlighted. Furthermore, the photographs of the products presented on www.mastromediapix.it do not constitute a contractual element, as they are only representative.
MASTROMEDIA undertakes to deliver the goods within 30 days of MASTROMEDIA's sending of the order confirmation email to the CUSTOMER.
ARTICLE 4 - Availability of products
The availability of products refers to the actual availability at the time the CUSTOMER places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other CUSTOMERS before the confirmation of the order.
Even after the order confirmation email sent by MASTROMEDIA, there may be cases of partial or total unavailability of the goods. In this event, the order will be automatically corrected with the elimination of the unavailable product and the CUSTOMER will be immediately informed by email.
If the CUSTOMER requests the cancellation of the order, terminating the contract, MASTROMEDIA will refund the amount paid within 14 days from the day on which MASTROMEDIA became aware of the customer's decision to terminate the contract.
ARTICLE 5 - Payment methods
Every payment by the CUSTOMER can only be made by means of the credit/debit cards indicated on the website www.mastromediapix.it, by bank transfer, with Paypal payment method or with installment payment.
In case of payment by credit/debit card, the actual charge will occur at the time of sending by MASTROMEDIA of the order confirmation email.
In case of payment with Paypal, the actual charge will occur at the time of sending by MASTROMEDIA of the order confirmation email.
Communications relating to payment and the data communicated by the CUSTOMER at the time it is made occur on dedicated secure lines. The security of payment with Credit Card is guaranteed through VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.
ARTICLE 6 - Prices
All sales prices of the products indicated on the website www.mastromediapix.it are expressed in Euros and include VAT, and where provided, the Raee contribution.
Shipping costs are not included in the purchase price, but are indicated and calculated at the time of completion of the purchase process before making the payment.
The CUSTOMER accepts the ability of MASTROMEDIA to change its prices at any time, however the goods will be invoiced based on the prices indicated on the site at the time of the creation of the order and indicated in the confirmation email sent by MASTROMEDIA to the CUSTOMER.
In case of computer, manual, technical error, or of any other nature that may involve a substantial change, not foreseen by MASTROMEDIA, of the retail price, which makes it exorbitant or clearly ridiculous, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.
ARTICLE 7 - Right of withdrawal
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days from the date of receipt of the products, MASTROMEDIA will refund the amount of the products subject to withdrawal within a maximum term of 14 days from the date of arrival at the headquarters.
The CUSTOMER who intends to exercise the right of withdrawal must communicate it to MASTROMEDIA through an explicit declaration, which can be sent by registered letter a.r. or by accessing the "My account" section of the "Order history..." space on the website www.mastromediapix.it, with the creation of a Return computer practice.
The CUSTOMER may exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 (not mandatory) the text of which is reported below:

In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day he communicated to MASTROMEDIA his intention to withdraw from the contract under art. 57 of Legislative Decree 206/2005.
The goods must be returned or hand delivered to MASTROMEDIA by Antonio Mastrorocco, at Via Montegappa 1, 70014, Conversano - Triggianello (BA).
In case of withdrawal with return of the product at the point of sale, the creation of the online return practice is still necessary.
The direct costs of returning the products are borne by the CUSTOMER. The cost can vary depending on the size of the package and the courier chosen, on average around €6.00 (six/00euro).
The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached fiscal documentation. Without prejudice to the right to verify compliance with the above, MASTROMEDIA will refund the amount of the products subject to withdrawal within a maximum period of 14 days.
As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, MASTROMEDIA can suspend the refund until receipt of the goods or until the CLIENT has demonstrated that they have returned the goods to MASTROMEDIA.
MASTROMEDIA will make the refund using the same means of payment chosen by the CLIENT at the time of purchase. In the case of payment made by bank transfer, and if the CLIENT wishes to exercise their right of withdrawal, they must provide MASTROMEDIA, by accessing the contact us section, with the bank details: IBAN, SWIFT and BIC necessary for the refund, by MASTROMEDIA.
ARTICLE 8 - Legal warranty of conformity
In case of receipt of products not conforming to orders or defective, the CUSTOMER has the right to restore the conformity of the product at no cost through repair or replacement of the product. The CUSTOMER can exercise this right if the defect manifests itself within two years from the delivery of the goods and reports the defect to MASTROMEDIA within two months of its discovery.
Subsequently, the customer will have to proceed with the creation of a computerized Return practice by accessing the "my account" section of the "Order history ..." space on the mastromediapix.it site. MASTROMEDIA, in case of defective or non-compliant product, will, at its own expense, organize the withdrawal of the product, compatibly with the availability of the CUSTOMER.
ARTICLE 9 - Commercial warranty
All products presented on the www.mastromediapix.it site benefit, in addition to the legal warranty of conformity referred to in the previous article, from a commercial warranty whose duration is mentioned on the product sheets of the articles.
To take advantage of the warranty assistance, the CUSTOMER must keep the invoice or order confirmation.
ARTICLE 10 - Delivery method
MASTROMEDIA will only accept orders to be delivered in Italian territory and in the Republic of San Marino. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order as soon as possible. Shipping costs start from a minimum of € 5.99 up to a maximum of 50.00 depending on the size and weight of the packages.
ARTICLE 11 - Liability
MASTROMEDIA assumes no responsibility for disservices attributable to force majeure or fortuitous event, even if dependent on malfunctions and disservices of the internet network, in the event that it is unable to execute the order within the times provided by the contract.
ARTICLE 12 - Access to the site
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, particularly commercial, of the site or its content is allowed. The integrity of the elements of this site, whether they are sound or visual, and the related technology used remain the property of MASTROMEDIA and are protected by intellectual property rights.
ARTICLE 13 - Cookies
The website www.mastromediapix.it uses 'cookies'. Cookies are electronic files that record information related to the CUSTOMER's navigation on the site (pages consulted, date and time of consultation, etc..) and that allow MASTROMEDIA to offer a personalized service to its customers.
MASTROMEDIA informs the Customer of the possibility of deactivating the creation of such files, by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.
ARTICLE 14 - Integrity
These General Sales Conditions consist of all the clauses that make them up. If one or more provisions of these General Sales Conditions are considered invalid or declared as such under the law, regulation or following a decision by a court of jurisdiction, the other provisions will continue to have full force and effect.
ARTICLE 15 - Applicable law and competent court
These General Sales Conditions are subject to Italian law.
Any dispute that does not find an amicable solution will be subject to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located in the territory of the State.
In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these sales conditions.
